TERMS AND CONDITIONS OF USE FOR ELEMENTS CASINO VICTORIA

1. DEFINITIONS

   For the purposes of these Terms and Conditions, the following definitions shall apply:

• "Casino" means Elements Casino Victoria and its affiliates;
• "Customer" means any person using or accessing the facilities of the Casino;
• "Gaming" includes participation in slot machines, table games, poker, electronic tables, and all other forms of gambling offered by the Casino.

2. ACCEPTANCE OF TERMS AND CONDITIONS

   By entering or using the premises of the Casino, including its gaming floor, amenities, dining areas, entertainment venues, or accessing any online features (if available), each Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.

3. AGE RESTRICTIONS

   The minimum age for participation in Gaming at the Casino is 19 years old. Customers are required to provide proof of age upon request.

4. RESPONSIBLE GAMING POLICY

   The Casino adheres to a Responsible Gaming Policy which includes measures aimed at preventing problem gambling, providing tools and resources to customers experiencing issues with excessive gaming, and promoting safe play habits. This may include self-exclusion programs, personal limit setting, referrals to support services, and educational materials.

5. DEPOSITS AND WAGERING LIMITS

   Customers are responsible for managing their deposits and wagering limits within the Casino's facilities or, if available, through any online platforms operated by the Casino in accordance with applicable laws and regulations.

6. GAMING SYSTEM SECURITY AND FAIR PLAY

   The Casino utilizes electronic gaming systems that meet provincial technical standards and payback requirements under BCLC regulation. The casino does not publicly disclose specific details about game fairness audits or certification but asserts compliance with regulatory oversight.

7. CUSTOMER SUPPORT

   Customer support services are available at the premises, by phone, or through channels linked from the website during operating hours, typically Monday to Sunday from 9:00 AM until 2:00 AM (Sunday-Thursday) and 4:00 AM (Friday-Saturday). Primary language for support is English.

8. LANGUAGE

   The primary language used at the Casino and on its website is English. Other languages may be accommodated informally by staff or through translated materials from BCLC’s GameSense program when available.

9. PERSONAL PROPERTY AND LIABILITY

   Customers are solely responsible for their personal property while within the premises of the Casino, including during Gaming activities. The Casino shall not be liable for any loss, theft, damage, or injury to Customers' property or persons unless caused by negligence on behalf of the Casino's employees or officers.

10. VIDEO AND PHOTOGRAPHY

    The use of cameras and mobile devices for photography or recording within the premises is strictly prohibited in areas where Gaming activities are taking place without prior written consent from management, except as part of regulatory compliance measures.

11. CHILDREN'S SAFETY

    Children under 16 years old must be accompanied by an adult at all times while on the Casino's premises and must not participate in Gaming or use any gaming-related facilities.

12. INTELLECTUAL PROPERTY RIGHTS AND TRADEMARKS

    The design, layout, software, databases, logos, names, graphics, trademarks of Elements Casino Victoria are owned by either its affiliates or BCLC. Any unauthorized reproduction, modification or distribution is strictly prohibited under applicable copyright and trademark laws.

13. BREACH OF TERMS AND CONDITIONS

    Failure to comply with these Terms and Conditions may result in the termination of a Customer's account (if online gaming features are available), denial of entry or participation in Gaming at the Casino premises, removal from casino property, or other enforcement as necessary to maintain compliance with regulatory requirements.

14. GOVERNING LAW AND JURISDICTION

    These Terms and Conditions shall be governed by and construed in accordance with applicable laws and regulations of British Columbia, Canada. Any disputes arising hereunder shall be settled through the Courts of that jurisdiction.

15. MODIFICATIONS TO TERMS AND CONDITIONS

    The Casino reserves the right to modify or update these Terms and Conditions at any time without prior notice. Customers' continued use after such changes indicate their acceptance of the updated policy.

16. EFFECTIVE DATE

    These Terms and Conditions are effective (the "Effective Date").

17. ENTIRE AGREEMENT

    This Agreement constitutes the entire understanding between Elements Casino Victoria, its affiliates or BCLC, on one hand, and Customers on the other. There are no oral agreements that may be given effect.

18. SEVERABILITY

    If any provision of these Terms and Conditions is deemed to be invalid, unlawful, or unenforceable under applicable law or regulation, such shall not affect the validity of or render inoperable all remaining provisions of this Agreement.

19. ACCEPTANCE OF CHANGES

    Any amendments made to the gaming systems software, technical standards or operating procedures by BCLC shall immediately become binding on Elements Casino Victoria as if those modifications had been made prior to Customer’s first visit or account creation (if applicable).

20. COMPLETE UNDERSTANDING

    Customers understand that they are subject to these Terms and Conditions at all times during their interaction with the Casino's facilities, online platforms, or staff.

By accepting this Agreement, Customers confirm understanding of these Terms and Conditions as complete and final, binding them and Elements Casino Victoria in all respects to the terms hereof.
